Be a BioWare Minion Contest

2008 Official Rules

NO PURCHASE NECESSARY. VOID IN QUEBEC, CANADA AND WHERE PROHIBITED.

1. Entry:

You must be a registered BioWare community member to participate in this Contest. To create a free BioWare community account, go to http://accounts.bioware.com/signup and click the sign-up button. Fill out the form and provide a valid email address. An email will be sent to the email address you provided. Follow the instructions to confirm your email address. To enter the Be a BioWare Minion Contest (the "Contest"), beginning 12:01pm MDT on July 10 2008 through 12:01pm MDT on August 4 2008 (the "Contest Period"), submit an email with "Minion Contest" and your BioWare Community account name in the subject line and a video as an attachment* (together, the "Entry") offering explanation of "Why I am the best choice to be the BioWare Minion* to contest@bioware.com using the email address you have associated with your BioWare community account. Completed entries must be received by 11:59 a.m. MDT on August 4, 2008. If your entry is temporarily or permanently removed from the video site, you will be disqualified from further participation in the Contest. No other methods of entry will be accepted.

Submissions will be emailed as an attachment to contest@bioware.com Video must be between one and two minutes in length. Any video that incorporates prohibited content, including but not limited to, third party creations, trademarks, names, or other third party property(ies), or the work of creative consultants, or the likenesses of any other real-life individuals, or any content that is pornographic, illicit, or otherwise not appropriate for audiences aged at least 13 years old or that otherwise in Sponsor's sole and absolute discretion violates the above Guidelines and/or is not in compliance with these Official Rules, will not be accepted for entry and will not be eligible to win any prize in this Contest.

Limit: Only one entry per BioWare community account name and email address will be accepted. By entering, entrants warrant that their Entries contain only their own, original creations. Entrants further warrant their Entries do not contain any third party copyrighted materials, and otherwise do not violate or infringe the rights, including, without limitation, copyrights, trademark rights or rights of publicity/privacy, of any third party. Sponsor, in its sole discretion, reserves the right to disqualify any Entry containing racial, religious, or ethnic slurs, explicit language, obscene, pornographic, violent, or sexual content, or libel, hate speech, references to alcohol, drugs or other illicit substances, or otherwise objectionable, offensive, illegal or prohibited material. Completed entries must be sent electronically during the Contest Period and received by 11:59 a.m. MDT on August 4, 2008. Sponsor assumes no responsibility for lost, incomplete, incorrect, or misdirected entries. Proof of submission of Contest Entry is not considered proof of delivery or receipt of such Entry by Sponsor. Sponsor and its Agents (defined below) assume no responsibility for lost, late, intercepted, incomplete, incorrect, or misdirected entries, or Entries not otherwise received by Sponsor. Use of a false email account will disqualify an Entry. Sponsor and its Agents are not responsible for technical, hardware or software malfunctions, misdirected entries, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, lost, late, illegible, misdirected, garbled, damaged or delayed electronic or other communications or other technical problems related to Entries. Any communication or information transmitted to Sponsor and/or the Site by electronic mail or otherwise, is and will be treated as non-confidential and nonproprietary. Sponsor, in its sole discretion, further reserves the right to disqualify any person who tampers with the entry process or the operation of the Site, or who otherwise violates these Official Rules. By entering, entrants accept and agree to abide by the terms of these Official Rules.

2. Eligibility:

This Contest is only open to residents of Canada (excluding Quebec), the 50 United States and the District of Columbia who are 21 years of age or older at time of entry and who had internet access as of July 1, 2008. Winner must be able to travel between the dates of August 28, 2008 and September 1, 2008 and attend the Penny Arcade Exposition (PAX) in Seattle Washington, USA. Residents of Quebec are not eligible. Employees of BioWare ULC and its respective parent, affiliates, subsidiaries, representatives, advertising, promotion and publicity agencies ("Sponsor and its agents") and the immediate family members and persons living in the same household of each are not eligible. Contest is void where prohibited, restricted or taxed by law. All federal, state and local laws and regulations apply.

3. Prizes:

There is one (1) prize.

One (1) winner will receive a Prize Trip package: a trip for winner to Seattle, Washington, $500 USD, three day access badge for the Penny Arcade Exposition, three (s) T-shirts and a Sony DCRDVD610 DVD Camcorder.

Trip includes roundtrip economy/coach class airfare for winner from a major commercial airport near the winner’s residence, hotel accommodations for 4 nights/5 days in one (1) single occupancy room at the Grand Hyatt Seattle; Incidentals, including, without limitation: telephone calls, facsimile charges, Internet charges, spa/beauty salon services, laundry, tours/excursions, gift shop purchases, hotel processing fees, airline service charges and all other expenses not mentioned in these Official Rules are the sole responsibility of the winner Hotel and airfare cannot be used separately. Winner will be notified by Sponsor of intended dates of travel by no later than 2 weeks prior to the intended date of departure. In the case that the winner cannot travel on August 28, 2008 to the PAX event, the prize will be forfeited in its entirety and an alternate will be chosen. Travel and accommodations are subject to availability and certain restrictions,. Any extra nights’ stay and any additional costs associated with an extended stay are the sole responsibility of the winner and his or her guest. Additional restrictions may apply.

The approximate retail value (ARV) of the prize is $2500.00. Actual value of Prize Trip may vary depending on winner’s residence and seasonal rates.

Prizes are not transferable. No substitution of prizes for cash or other goods and services is permitted, except Sponsor reserves the right to provide a substitute prize of approximately equal or greater value, if the advertised prize becomes unavailable. T-shirt sizes to be awarded as prizes are within the sole discretion of Sponsor and subject to availability. All taxes, including, without limitation, all federal, state and local taxes, and international tariffs, are the sole responsibility of the each individual winner.

4. Winner Selection and Notification.

Winners will be determined on or about August 5, 2008 from all eligible entries received as follows:

Sponsor or its designee, the judge of the Contest, in their sole discretion, will rank the entries based on the following criteria: 50% Originality; 30% Appropriateness to topic and 20% professionalism. In the unlikely event of a tie, the winner will be the entrant with the highest ranking in the creativity category. Winners will be notified on or about August 6, 2008 by an email sent to the email address specified on the Contest entry. Winner will be required to complete and sign an Affidavit of Eligibility and, except where prohibited, Liability/Publicity Release, and any required non-disclosures, in the form provided by Sponsor, within 7 days of attempted notification in order to claim Prize. If the winner cannot be contacted at the email address provided, is contacted and does not respond as directed within 7 days of attempted notification, refuses the prize or is ineligible to accept the prize, the prize may be forfeited and awarded to an alternate winner. All prizes claimed in accordance with the Official Rules will be awarded. Winner may be required to provide a shipping address to claim prize. Allow 2-4 weeks for delivery of prize.

5. General Conditions.

Sponsor and its agents are not in any way responsible or liable for damages, loss or injury resulting from participation in this Contest or the acceptance, possession, shipping and handling, loss, use or mis-use of any prizes awarded in this Contest. Entrants and winners assume sole liability for injuries, including personal injuries and/or damage to property, caused or claimed to be caused by participating in this Contest or the acceptance, possession, shipping and handling, loss, use or mis-use of any prize awarded. Sponsor has the right to cancel, terminate or modify this Contest if it cannot be completed as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or other conditions beyond Sponsor's control, and to select winners from eligible entries received on or before the termination date.. Sponsor is not responsible for any failure to contact entrants whether due to technical or human error.

By entering this Contest, entrants agree (i) that Sponsor may post their entries on Sponsor’s website and in any and all publicity and advertising for BioWare, this Contest or other promotions by sponsor without any further attribution, notification or compensation to entrants and, except if entrant is a resident of TN or otherwise where prohibited by law has the right to use entrant’s user or screen name and hometown, likeness , photograph, therewith; (ii) agree to be bound by these Official Rules and the decisions of the judges (iii) agree to be contacted by Sponsor] or its agents by telephone, mail and/or email regarding this Contest and (iv) irrevocably assign and transfer to Sponsor any and all rights, title, and interest in the entry, including without limitation, all copyrights and a waiver of all moral rights in the entry. Sponsor, in its sole discretion, may edit, composite, morph, scan, duplicate, alter and/or otherwise modify any entry, in whole or in part, for publication or for any other purpose. Sponsor shall have no obligation (express or implied) to use any of the entries. Entrants shall not be entitled to any damages or other relief by reason of Sponsor’s use or non-use of any entry. The Contest is governed by the laws of the United States and all claims must be resolved in the United States. If there is a dispute regarding the identity of an entrant, the entry will be deemed submitted by the person in whose name the email account is registered.

6. Winners list:

A winners list will be available on http://masseffect.bioware.com/contest_winners.html after a winner is determined and verified, and posted for approximately two weeks and is also available by sending a stamped, self addressed envelope for receipt by August 22, 2008, marked "Be a BioWare Minion" to
